EngX is a product of Lynera

Welcome to EngX! These Terms of Service ("Terms") govern your access to and use of EngX, a platform developed and operated by Lynera ("we," "us," or "our"). By accessing or using EngX, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using EngX, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the platform.

2. Description of Service

EngX is an online platform offering engineering problem-solving challenges, competitive leaderboards, progress tracking, AI-powered hints, and other features designed to help engineers improve their skills. EngX is developed and maintained by Lynera.

3. Subscription Tiers

EngX offers four subscription tiers:

Access to 20+ basic problems
Basic progress tracking

3 AI hints per day
Cost: $0/month

3.2 Pro Tier

Access to 200+ problems
Advanced analytics
Priority support
Profile customization
10 AI hints per day
Cost: $9.99/month (recurring monthly subscription)

3.3 Pro+ Tier

All Pro features
Unlimited problems
Advanced AI-powered insights
Custom problem sets
30 AI hints per day
Cost: $14.99/month (recurring monthly subscription)

3.4 Founding Engineer Tier

Lifetime access to all platform features
Special "Founding Engineer" badge
All Pro+ features
50 AI hints per day
Priority feature requests
Cost: $29 (one-time payment, lifetime access)

4. Payment Terms

4.1 Payment Processing

All payments are processed securely through Stripe. By subscribing to a paid tier, you authorize Stripe to charge the applicable fee to your payment method.

4.2 Recurring Subscriptions

Pro and Pro+ subscriptions automatically renew monthly until canceled. You may cancel your subscription at any time through your account settings or by contacting support@engx.com.

4.3 Founding Engineer Tier

The Founding Engineer tier is a one-time payment that grants lifetime access to EngX. This tier is subject to availability and may be discontinued at any time.

4.4 30-Day Money-Back Guarantee

All paid subscriptions include a 30-day money-back guarantee. If you are not satisfied with your subscription within the first 30 days of purchase, you may request a full refund by contacting support@engx.com.

4.5 Refund Policy

After the 30-day guarantee period, subscriptions are non-refundable except as required by law or at our sole discretion.

5. Platform Continuity Guarantee

5.1 6-Month Guarantee

EngX offers a 6-month platform continuity guarantee from your subscription purchase date. If EngX discontinues operations or materially reduces its core functionality within this 6-month period, you are entitled to ONE of the following:

Full refund of your subscription fee
Lifetime access to any successor platform or service offered by Lynera
$50 credit toward Lynera products or services

5.2 Feature Preservation

During the 6-month guarantee period, we commit to maintaining the core features available at the time of your subscription purchase. Core features include:

Problem-solving challenges
Progress tracking
Leaderboards
AI hint system (subject to daily limits)
User profiles

5.3 Claiming the Guarantee

To claim the platform continuity guarantee, contact legal@engx.com within 30 days of service discontinuation with proof of subscription purchase.

6. AI Hint System

6.1 Hint Usage

AI-powered hints are provided to help you solve problems. Daily hint limits apply based on your subscription tier.

6.2 Hint Quality

While we strive to provide accurate and helpful hints, we do not guarantee the correctness or completeness of AI-generated content. Hints are for educational purposes and should be verified independently.

6.3 Hint Flagging

You may flag hints that are confusing or unhelpful. Flagged hints are reviewed by our team to improve quality.

6.4 Data Usage

AI hint interactions may be logged for quality assurance and platform improvement. See our Privacy Policy for details.

7. User Conduct

You agree to:

Use EngX only for lawful purposes
Not share your account credentials
Not attempt to circumvent subscription limits or features
Not abuse the AI hint system or flag system
Not upload malicious code or attempt to exploit vulnerabilities
Respect intellectual property rights
Not harass, impersonate, or harm other users

Violation of these terms may result in account suspension or termination.

8. Intellectual Property

8.1 EngX Content

All content on EngX, including problems, solutions, graphics, code, and documentation, is owned by Lynera or its licensors and protected by copyright, trademark, and other intellectual property laws.

8.2 User Content

By submitting content (e.g., flagging issues, providing feedback), you grant Lynera a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for platform improvement.

8.3 License to Use

You are granted a limited, non-exclusive, non-transferable license to access and use EngX in accordance with these Terms.

9. Privacy

Your use of EngX is subject to our Privacy Policy, which describes how we collect, use, and protect your information. Please review the Privacy Policy at PRIVACY_POLICY.md.

10. Disclaimers

10.1 "As-Is" Service

ENGX IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Professional Advice

EngX is for educational purposes only. It does not provide professional engineering advice, certification, or licensure.

10.3 Service Availability

We strive for high availability but do not guarantee uninterrupted or error-free service. We may suspend or modify the service for maintenance, updates, or security reasons.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYNERA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF ENGX, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL LYNERA'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lynera and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of EngX or violation of these Terms.

13. Termination

13.1 By You

You may terminate your account at any time by contacting support@engx.com or through your account settings.

13.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

13.3 Effect of Termination

Upon termination, your access to EngX will cease, and you will lose any unused subscription benefits. Refunds (if applicable) will be handled according to Section 4.

14. Dispute Resolution

14.1 Informal Resolution

If you have a dispute, please contact legal@engx.com. We will attempt to resolve disputes informally before pursuing legal action.

14.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to participate in class actions or class arbitrations.

14.3 Governing Law

These Terms are governed by the laws of the United States and the state where Lynera is incorporated, without regard to conflict of law principles.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of EngX after changes constitutes acceptance of the updated Terms.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lynera regarding EngX.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
